State v. Hemminger

The Supreme Court affirmed the judgment of the circuit court convicting Defendant of first-degree murder and sentencing him to mandatory life in prison. The court held (1) the circuit court did not err in its evidentiary rulings that Defendant consented to the seizure of his property from the hospital and that the revocation of that consent did not require the return of his property; (2) the circuit court did not err in denying Defendant’s motion to suppress evidence seized at Defendant’s friend’s house; (3) the circuit court did not abuse its discretion when it admitted twenty-six autopsy photographs during the trial; (4) the circuit court did not err in denying Defendant’s motion for a new trial on his claim of improper burden shifting; and (5) the evidence was sufficient to support Defendant’s conviction.
